The Federal High Court in Abuja has denied the request of Mohammed Tukur Mamu, a terrorist negotiator, to be transferred from the Department of State Service (DSS) custody to Kuje Prison. Mamu is currently facing terrorism charges brought by the Federal Government.
Mamu has been held in DSS custody since his bail request was denied. In the recent ruling, Justice Inyang Edem Ekwo cited the Federal Government’s concerns about prison escapes as the primary reason for rejecting the transfer to Kuje Prison. He noted that Mamu did not challenge these concerns, which under the law, means they are accepted as true without further proof. Consequently, Mamu will remain in DSS custody throughout his trial.
However, Justice Ekwo upheld his previous order allowing Mamu to consult his personal physician for medical treatment under DSS supervision. Mamu’s lawyer, Abdul Mohammed, SAN, argued that the DSS had not complied with a court order from December 19, 2023, which granted Mamu access to his personal physician. Mamu was only allowed to see the physician once, resulting in a medical report submitted to the DSS. Since then, Mamu has not been permitted further visits, despite his need for surgical operations.
Mamu claimed his health has deteriorated and his life is at risk if he continues to be held by the DSS. He assured the court of his commitment to attend proceedings, emphasizing his need for adequate medical care to survive the trial.
Mamu was arrested at the Aminu Kano International Airport upon returning from Egypt on September 6, 2022, due to his alleged involvement with the terrorists responsible for the March 28, 2022, attack on the Abuja-Kaduna train. On March 21, 2023, the DSS charged him with 10 counts of terrorism financing and related offenses, to which he pleaded not guilty.
