The application is part of an ongoing case before the Kaduna State High Court.
During Tuesday’s proceedings, defence counsel, Ubong Akpang, informed the court that a fresh bail request had been filed, stressing that it concerns his client’s personal liberty. He added that all necessary documents had been submitted and served, and that the defence was ready to proceed.
However, ICPC counsel, Ibrahim Mukhtar, told the court he had only just received the defendant’s additional affidavit supporting the application and requested time to review it. Following this, the court adjourned the matter to May 13, 2026, for the hearing of the bail request.
The court had earlier declined to grant bail to El-Rufai in a previous application. Justice D.H. Khobo ruled that the defendant failed to respond adequately to the ICPC’s counter-affidavit, which raised concerns including potential flight risk, alleged obstruction of arrest at the Nnamdi Azikiwe International Airport, refusal to submit travel documents and devices, and the possibility of interfering with witnesses and evidence.
The judge emphasised that bail is discretionary and must align with the interest of justice, noting that El-Rufai’s position and influence could affect ongoing investigations, especially as some suspects remain at large.
The court also pointed out that the defendant did not challenge key allegations raised by the prosecution, effectively treating them as admitted. It further dismissed his health-related claims due to lack of supporting evidence.
As a result, the court ordered that he remain in ICPC custody pending trial and directed that the case be fast-tracked.
Despite the earlier ruling, the defence has filed a new bail application, while the ICPC reiterated its commitment to pursuing corruption cases in line with due process.
