Legal practitioners in the Niger Delta region have criticized the outcome of the peace talks initiated by President Bola Tinubu to address the ongoing political conflict in Rivers State. Prominent legal figures, including former Akwa Ibom Attorney General Uwemedimo Nwoko, emphasized that parties cannot agree on actions that defy the constitution. The lawyers argued that the return of 27 lawmakers to the House and the directive to re-present the appropriation bill constitute illegality and cannot override constitutional provisions.
Eric Omare stressed that agreements lacking legal backing cannot supersede the law, especially when constitutional matters are at stake. Ted Eno highlighted the explicit provisions in the Nigerian constitution regarding legislators crossing party lines and argued that the continued stay of the Assembly members is unconstitutional and illegal.
Several legal experts, including Amaebi Clarkson, Ogunbiyi Olajuwon, and Kayode Ajulo, criticized the president’s role in the resolution, describing it as a disregard for the constitution. They emphasized the need for adherence to the rule of law, with Amaebi Clarkson suggesting that Governor Fubara pursue legal avenues to challenge the resolution.
In contrast, Kunle Adegoke defended President Tinubu’s intervention, stating that there is nothing unconstitutional about it. He argued that the president’s role is to mediate and call parties to order in the interest of resolving the crisis. However, Israel Olorundare and others, including Fashola and Falana, asserted that President Tinubu has no constitutional authority in the matter and called for a legal resolution to the crisis.
As the controversy unfolds, legal experts remain divided on the constitutionality of the Tinubu-brokered peace deal, with some viewing it as a necessary intervention and others condemning it as an infringement on the rule of law.
