An Ibadan-based lawyer, Olutayo Oyewale, has petitioned the Controller General of the Nigeria Correctional Service (NCS), Haliru Nababa, over allegations of misconduct and perversion of justice by staff at the Ilesa Custodial Centre in Osun State. The lawyer accuses the staff of attempting to manipulate the legal process. In the document, obtained by PUNCH Online in Ibadan, Oyewale calls for a thorough investigation into the matter and appropriate sanctions if any wrongdoing by the staff is confirmed.
The issue stems from a case heard by Magistrate Olusegun Ayilara at Court 1, Osogbo, under suit number MOS/200c/2024. The case involves defendants Samson Adediji and Adeoti Adebise Awanat, who were charged with conspiracy and obtaining N25 million under false pretenses. Both defendants were granted bail, but due to difficulties in meeting the bail conditions, they were remanded at the Ilesa Custodial Centre.
Oyewale alleges that instead of following the court’s order, the Osun State NCS attempted to secure the unconditional release of one of the defendants by writing a letter to the court. He also claims that on August 16, 2024, during a scheduled court hearing, the second defendant, Adeoti Adebise, feigned illness in the dock. Without a court order, she was taken away by her husband in a private car and was not returned to the facility.
The petition continues, expressing concern over the lack of transparency in the actions of the custodial center, as no valid court order was provided for the defendant’s release. Furthermore, when the case was revisited on September 2, 2024, Adeoti was absent from the court. Instead, a letter from the NCS stated that she had given birth and was receiving medical treatment in an undisclosed hospital.
The letter, signed by Chief Superintendent A.A. Alade of the Ilesa Custodial Centre, confirmed the birth of Adeoti’s child on August 29, 2024, following a Caesarean section. It was read in open court by Magistrate Ayilara. Oyewale questioned the actions of the custodial staff and raised concerns about the potential risk of the defendant fleeing.
In the petition, Oyewale urged the NCS to conduct a discreet investigation into the activities of its staff at the Osun State Command, emphasizing the need for strict disciplinary action against any collusion or misconduct.
