Legal expert Femi Falana (SAN) has emphasized that the Defence Headquarters’ declaration of murder suspects as wanted is unlawful. He insists that the federal government should instruct the army to transfer the investigation of these suspects, implicated in the brutal killing of 17 officers and soldiers, to appropriate civilian authorities.

Falana argues that murder does not fall under the jurisdiction of the Defence Headquarters for investigation. He warns that failure to rectify this could jeopardize the murder case.

In response to the Nigerian army’s publication of wanted lists, Falana underscored the illegality of military involvement in civilian arrests and investigations. He referenced legal precedents, such as the case of Dr. Issa Perry Brimah v Nigerian Army, where it was ruled that the military cannot declare civilians wanted without following due process.

Highlighting another case, Miss Grace Anita Paul v. The Chief of Army Staff, Falana reaffirmed the judiciary’s stance that the army lacks authority to detain civilians not subject to military law.

Furthermore, he stressed the necessity of court orders for declaring suspects wanted, citing the ruling in Benedit Peters v Economic and Financial Crimes Commission, which deemed the EFCC’s actions unlawful without prior judicial approval.

Falana urges the federal government to intervene and redirect the investigation to civilian agencies, emphasizing that murder is not within the military’s purview. He warns that failure to do so would compromise the integrity of the murder case.
