The Mpumalanga Division of the High Court in South Africa handed down a life sentence on Tuesday to 51-year-old Josaya Ndlozi for the murder of his girlfriend, Sophie Phumzile Malele, following accusations of infidelity.
In accordance with Section 103 of the Firearms Control Act 60 of 2000, Ndlozi was automatically deemed unfit to possess a firearm.
The court learned that Ndlozi and Malele had been living together in Lydenburg and were parents to three children. Prior to the tragic incident, Malele had obtained an interim protection order against Ndlozi, which prohibited him from assaulting, threatening, or harassing her due to the volatile nature of their relationship.
On the morning of February 8, 2023, while their children were at school, an argument erupted between the couple. The confrontation escalated, leading Ndlozi to fatally stab Malele in the upper body. Upon realizing that she was unresponsive, Ndlozi notified a neighbor and contacted the police.
Malele was pronounced dead at the scene, with the cause of death determined to be multiple sharp force injuries to the neck. Ndlozi was subsequently arrested.
In court, Ndlozi admitted to the crime and was convicted of premeditated murder. State Advocate Senzo Zindela argued for a fitting sentence, asserting that Ndlozi’s guilty plea was not a sign of remorse but rather a response to the overwhelming evidence against him.
Before delivering the sentence, Acting Judge Manthata highlighted the severity of the crime, noting that Ndlozi had violated Malele’s constitutional right to life, leaving three young children without a mother. The judge emphasized that gender-based violence and femicide remain a pervasive issue in society, finding no justification for leniency from the prescribed minimum sentence of life imprisonment.
The National Prosecuting Authority (NPA) expressed its satisfaction with the court’s decision, reiterating its strong commitment to prosecuting cases of Gender-Based Violence (GBV) and femicide. The NPA stated that this case serves as a powerful reminder of the importance of protecting vulnerable members of society and holding those who commit such crimes fully accountable for their actions.
