The assembly has requested the Chief Judge of the state, Justice Olusegun Odusola, to establish a seven-member panel to investigate the allegations of gross misconduct against the Deputy Governor.

In a letter dated October 23, Rt Hon Olamide Oladiji informed the Chief Judge that the federal high court’s interim injunction in suit FHC/ABJ/CS/1294/2023 has lapsed in accordance with the law.

Previously, on October 3, the lawmakers had urged the Chief Judge to form the seven-member panel to investigate the allegations against Ayedatiwa. However, the Chief Judge had stated that due to the federal high court’s injunction, no proceedings or determinations by the House of Assembly or the Panel could be entertained or challenged in any court until the injunction expired.

In the new letter, the Speaker of the House requested the Chief Judge to promptly constitute the panel.

The letter reads, “Based on the facts and legal advice available to the House, the said Order has now expired and/or become null and void due to the operation of the law, in consideration of the clear provisions of Order 26 Rule 10 (2) & (3) of the Federal High Court (Civil Procedure) Rules, 2019, which states the following:

“An application to vary or discharge an order ex parte may be made by the party or any affected person within 14 days after service and shall not last more than fourteen days after the application has.”
