According to Naija News, Justice Kekere-Ekun has been serving as Acting Chief Justice since August, following the retirement of her predecessor, Justice Olukayode Ariwoola. She was sworn into the acting position by President Tinubu.

In his letter, the President cited Section 231(1) of the Nigerian Constitution, which grants him the authority to appoint the Chief Justice on the recommendation of the National Judicial Commission (NJC), subject to Senate confirmation.

The letter read, “In line with Section 231(1) of the Constitution of the Federal Republic of Nigeria, 1999 (as amended), which empowers the president to appoint the Chief Justice of Nigeria (CJN) on the recommendation of the National Judicial Council (NJC) and subject to Senate confirmation, I hereby forward the nomination of Honourable Justice Kudirat Kekere-Ekun CON for confirmation as CJN.”

President Tinubu expressed hope that the Senate would promptly consider and confirm Kekere-Ekun’s nomination, while offering his highest regards to the Senate President.

Following the presentation, Senate President Akpabio referred the nomination to the Committee of the Whole for further deliberation, with discussions scheduled for Wednesday.
