Suspended UNICAL Professor Granted Court Permission To Appeal Ruling
A Federal High Court in Abuja has granted permission to Prof. Cyril Ndifon, the suspended Dean of the Faculty of Law at the University of Calabar (UNICAL), to appeal the court’s decision that dismissed his no-case submission in the charges against him. Justice James Omotosho also authorized Ndifon’s lawyer, Mr. Sunny Anyanwu, to proceed with filing an appeal against the dismissal of the no-case submission.
This decision came after a motion was filed by Ndifon and Anyanwu’s counsel, Joe Agi, SAN, and it was unopposed by the Independent Corrupt Practices and Other Related Offences Commission (ICPC)’s lawyer, Osuobeni Akponimisingha.
The judge had previously, on March 6, rejected the no-case submission filed by Ndifon and Anyanwu, citing that the evidence presented by the prosecution established a prima facie case against them. As a result, Justice Omotosho directed them to enter their defense in response to the charges.
During the recent court appearance, Akponimisingha informed the court that the proceedings were scheduled for the defendants to commence their defense, expressing readiness to proceed. However, Agi brought two motions to the court’s attention on behalf of his clients.
