In his ruling on Friday, Justice Omotosho upheld the defendants’ “no-case” submission, stating that the Nigeria Police Force (NPF) had failed to present credible evidence linking the accused to the charges. As a result, the judge dismissed the three-count charge brought against them.
The case, initiated by Inspector-General of Police Kayode Egbetokun, involved accusations that the 50 individuals were involved in terrorism-related activities. The charges, filed on February 9, 2024, stemmed from an alleged incident in Umunze Village, Aguata Local Government Area, Anambra State, on December 12, 2023. The suspects were reportedly apprehended by officers of the NPF’s Anambra Command, led by Collins Eruogwu, in collaboration with a local vigilante group.
The police claimed that the defendants had gathered in a 911 truck, bearing the registration number XA-139 BDN, to discuss terrorism-related matters. They were also allegedly found with 48 black caps, 25 red caps, and six orange caps bearing the IPOB emblem, which the police said were imbued with charms believed to render the wearers invisible during illicit activities.
The prosecution further argued that the defendants intended to intimidate the people of Anambra State through their assembly, thereby violating the Terrorism (Prevention and Prohibition) Act, 2022. However, the court ruled that the prosecution’s evidence was insufficient to prove the charges, leading to the dismissal of the case.
