Adamu Abdullahi, the Acting Chief Executive Officer of FCCPC, emphasized that Meta has been held accountable for infringing upon the rights of Nigerian data subjects. This includes allegations of denying individuals the ability to control the unauthorized transfer and sharing of their data, along with violations related to cross-border storage regulations.

The FCCPC disclosed that Meta was found guilty of discriminatory practices, abuse of dominance, and violations concerning tying and bundling. The investigation into Meta, initiated in May 2021, involved the issuance of an Order and Notice to Show Cause (ONSC) to WhatsApp LLC and Meta Platforms, Inc. The Commission’s findings prompted Meta to provide information and engage in discussions with investigators and analysts from both the FCCPC and the Nigeria Data Protection Commission (NDPC) over a period spanning 38 months, until December 2023.

The investigation concluded that Meta’s actions over this period constituted repeated infringements of the FCCA and NDPR, involving practices such as unauthorized appropriation of personal data, discriminatory treatment of Nigerian consumers, and exploitation through non-compliant privacy policies.

Having reviewed the evidence and afforded Meta ample opportunity to present its defenses, the FCCPC has issued a Final Order mandating specific compliance measures and prohibiting further violations. Additionally, the Final Order imposes a monetary penalty of Two Hundred and Twenty Million U.S. Dollars ($220,000,000.00), as stipulated by the FCCPA 2018 and the APR, reflecting the seriousness of the breaches identified.
