Court Halts FCT Minister’s Plan To Sell Abuja Land Amid Legal Battle
The Abuja High Court has issued an interim injunction preventing the Minister of the Federal Capital Territory (FCT), Nyesom Wike, and other respondents from selling a disputed property located at Plot No. 4411, Cadastral Zone A09, Guzape District, Abuja.....KINDLY READ THE FULL STORY HERE▶
Justice Mohammed Zubairu granted the injunction after an ex-parte motion was filed by Reuben Atabo (SAN), the counsel representing the applicant, Nextdora Nigeria Limited.
The motion, marked M/16807/2024, was heard on Monday, and a certified true copy of the ruling was provided to journalists on Tuesday.
In his ruling, Justice Zubairu emphasized that the injunction was necessary to ensure fairness and uphold the principle of justice. He explained that the interim order would remain in effect for a few days until all parties are served and appear before the court for the hearing of the motion on notice.
The judge ordered the defendants, including the FCT Minister and the Federal Capital Development Authority (FCDA), to avoid trespassing or interfering with the claimant’s possession of the property until the motion is heard.
“The interim injunction restrains the defendants, their agents, and anyone acting on their behalf from trespassing or interfering with the claimant’s exclusive possession of the property,” Justice Zubairu stated.
Additionally, the court granted three other requests from the applicant, including halting any development or reassignment of the property. The case has been adjourned to December 30 for a hearing on the substantive suit.
The defendants in the case include Eric Anyamene Nnamdi, Bilikisu Mallam, the FCT Minister, and the FCDA.
Nextdora Nigeria Limited, the applicant, asserts ownership of the land, which is covered by a Right of Occupancy under File No. MISC 128232. The company has asked the court to recognize it as the legitimate titleholder and prevent the defendants from selling or developing the property.
