The absence of Yaro during the commencement of the trial led to a delay in proceedings on the previous day. Through a motion on notice designated as FCT/HC/CV/6918/23, Yaro’s legal representation, led by J.B Daudu SAN, requested the court to declare her arrest on July 12, 2023, along with her husband’s detention and the confiscation of her six high-end cars, as a violation of her fundamental human rights.

Daudu further argued that the DSS, lacking the status of an anti-graft agency, lacked the jurisdiction and statutory authority to delve into the business affairs of the applicant.

He contended that the extended detention and reported mistreatment of Yaro by the DSS since July 12, 2023, were clear infringements on her constitutionally protected Rights to Dignity of Human Person and Personal Liberty, as guaranteed by Sections 34 and 35 of the 1999 Constitution of the Federal Republic of Nigeria.
