Residents of Tudun Biri in the Igabi Local Government Area of Kaduna State have taken legal action against the Nigerian Government, seeking compensation of N33 billion in the aftermath of recent airstrikes conducted by the Nigerian Army that resulted in the death of over 100 individuals.

The lawsuit was officially filed on December 8 by the villagers’ legal representative, Mukhtar Usman Esq., at the Federal High Court in Kaduna. Alongside the monetary compensation, the villagers are also demanding a public apology to be published in at least three national newspapers.

The legal action aims to uphold the survivors’ fundamental rights to life in the wake of the tragic incident. One of the primary declarations sought in the suit is the recognition that the aerial bombardment, leading to the demise of individuals celebrating the Islamic Maulud in Tudun Biri on December 3, 2023, under the command of the Chief of Army Staff, constitutes a violation of the victims’ fundamental rights to life. This violation is argued to be contrary to Section 33 of the 1999 Constitution of the Federal Republic of Nigeria and Article 10(1) of the African Charter on Human and Peoples’ Rights (Ratification Enforcement) Act (Cap 10) LFN 2010.
