Court Grants Bukola Saraki Permission To Modify Legal Action Against EFCC And ICPCA Federal High Court in Abuja has granted a motion from former Senate President Bukola Saraki to amend his two separate lawsuits against the Economic and Financial Crimes Commission (EFCC) and other parties. Justice Ekwo had previously dismissed Saraki’s two lawsuits on January 25 due to inadequate prosecution. Saraki filed these lawsuits, designated as FHC/ABJ/CS/507/2019 and FHC/ABJ/CS/508/2019, on May 10, 2019, naming the Attorney-General of the Federation (AGF), the Inspector-General of Police (I-G), and the State Security Service (SSS) as the first to third defendants, while the EFCC, the Independent Corrupt Practices and Other Related Offences Commission (ICPC), and the Code of Conduct Bureau (CCB) were listed as the fourth to sixth respondents.
Following the dismissal, Saraki sought to have the cases reinstated. On February 1, he filed a motion requesting the relisting of the suits, which was subsequently granted by the judge.
During the latest hearing, Afe-Babalola informed the court that a motion to amend their original motion had been filed on July 29 and that all respondents had been served by July 31. Counsel for the SSS, EFCC, ICPC, and CCB did not oppose the amendment application. Justice Ekwo granted the request and adjourned the case until February 6, 2025, for further hearing, warning that any counsel responsible for delays would face personal penalties.
Saraki’s legal action stemmed from an investigation by the EFCC into his earnings from 2003 to 2011 during his tenure as governor of Kwara State. Reports indicated that the EFCC had seized several of his properties in Lagos’s Ikoyi area.
On May 10, 2019, Saraki filed the lawsuits to contest the EFCC’s actions. Justice Taiwo Taiwo, who initially presided over the case, had issued an order halting the EFCC’s investigation until Saraki’s motion was resolved. Following the EFCC’s request for recusal, the case was reassigned to Justice Anwuli Chikere, who later expressed concerns about the delays caused by the previous order. After Justice Chikere’s retirement, the case was transferred to Justice Ekwo for resolution
