Allegedly loyal to Governor Siminalayi Fubara, the defendants were implicated in the political crisis that rocked the state in October of the previous year. They were accused of attempting to frustrate the impeachment of the governor by invading the House of Assembly complex. The charges included the killing of a Superintendent of Police, Bako Agbashim, and five police informants at Ahoada community in Rivers State.

The prosecution asserted that the defendants utilized various cult groups, such as the Supreme Viking Confraternity, Degbam, Iceland, and Greenland, to sow chaos among the state’s populace and disrupt commercial activities.

While the immediate past factional Speaker of the Rivers State House of Assembly, Hon Edison Ehie, was not directly listed in the charges, he engaged a Senior Advocate of Nigeria, Oluwole Aladedoy, to represent him, citing mentions of his name in some counts. However, the court refused to entertain arguments on his behalf, stating that he was not yet a defendant.

Despite the defendants pleading not guilty, the prosecution requested a trial date and urged the court to remand them in prison custody. Lukman Fagbemi, SAN, representing the defendants, applied for their release on bail, stating that they had been in police custody since their arrest the previous year. The prosecution opposed the bail application, citing the need for time to review and respond to the motion.

In a bench ruling, Justice Bolaji Olajuwon agreed with the prosecution, deeming the bail applications not ready for hearing. The court adjourned the matter to February 2 to consider the bail applications and directed the defendants to be remanded at Kuje Prison in Abuja until then.

The charges against the defendants included allegations of conspiracy and acts of terrorism by willful destruction of public properties, particularly the invasion, attack, destruction, and burning of the Rivers State House of Assembly complex on October 29, 2023. The charges were brought under Section 26 of the Terrorism Prevention and Prohibition Act 2022, and Section 1 of the Miscellaneous Offences Act, Cap M17 Laws of the Federation of Nigeria 2004.
