Pending the determination of his bail application, the court ordered Agunloye to remain in custody. The charges brought against him are related to a $6 billion power scheme associated with the Mambilla hydropower project, for which the EFCC had declared him wanted. Agunloye served as a minister during President Olusegun Obasanjo’s administration between 1999 and 2003 and has been implicated in the controversy surrounding the Mambilla power project. Obasanjo accused him of unlawfully awarding the scheme with the approval of the Federal Executive Council, a claim Agunloye vehemently denies.

In a statement issued on December 22, 2023, by his friend, Oluwafisan Bankale, Agunloye expressed confidence that the charges of fraud and forgery against him would not hold, asserting his innocence. He emphasized that his detention by the EFCC had taken a toll on his health and thanked his family, friends, associates, and facilitators for their support. Agunloye also called for transparency in identifying all parties involved in the controversy and holding them accountable, stating that such actions would demonstrate the government’s commitment to addressing corruption in the country.

Notably, the EFCC had rearrested Agunloye on December 13, 2023, after obtaining an arrest warrant, citing allegations that he had jumped bail.
