The suit was filed on August 8 by the Incorporated Trustees of Egalitarian Mission for Africa (EMA), along with Professor Bola Akinterinwa and lawyer Nuhu Dantani. They sought relief from sanctions that included electricity cuts and movement restrictions implemented in response to the coup.

During the proceedings, Ifunanya Okeke, representing the applicants, moved to discontinue the case, explaining that the original issues had been rendered irrelevant by recent developments, including the restoration of electricity and the lifting of movement restrictions in Niger.

The court agreed to strike out the case, with respondents from the Federal Ministry of Justice, Mustapha Abubakar and Oluwarotimi Ibitoye, not objecting or seeking costs.

Initially, the plaintiffs argued that the sanctions were unlawful and violated international law, as part of broader measures like border closures and asset freezes aimed at restoring democracy in Niger. However, ECOWAS lifted all sanctions on February 24 for humanitarian reasons, influencing the court’s decision to dismiss the suit.
