Speaking to reporters on Wednesday, Falana, who represents the 38 soldiers, urged Tinubu to recognize that the previous administration under President Muhammadu Buhari ignored the directive from the National Industrial Court and the resolutions from the National Assembly that ordered the officers’ reinstatement.
He also highlighted the injustice and lack of fair hearing in the case of the 38 officers, stressing that proper procedures were not followed in their retirement.
Falana demanded their reinstatement, emphasizing that the officers had committed no offense.
He further noted that the officers were forced into retirement by the Nigerian Army on June 9, 2016, and the unjust action affected nine major generals, 11 brigadier-generals, seven colonels, and 11 lieutenant colonels.
Falana stated, “As the Commander-in-Chief of the Nigerian Armed Forces, I want to bring to President Tinubu’s attention the injustice that occurred to the 38 Army officers under the previous administration. This action was not only incredible but also unfortunate. I also want to point out that the wrongful action against the 38 officers is clearly illegal and unjustifiable.”
“The Nigerian Army must not be allowed to disregard the valid and existing order from the National Industrial Court and the National Assembly resolution regarding the 38 officers,” he added.
