While acknowledging INEC’s commendable efforts in organizing the 2023 general election and off-cycle elections, particularly in the efficient delivery of logistical support, Gabam pointed out that the commission’s performance continues to be influenced significantly by the executive branch.

Gabam candidly asserted that INEC lacks true independence, highlighting a common misconception among the public. He explained that INEC Chairman, Prof. Mahmood Yakubu, is constrained in overseeing elections, as his role is limited to producing and delivering election materials, deploying staff, and supervising the process.

According to Gabam, the existing legal framework places the responsibility for appointing the INEC chairman, national commissioners, and Resident Electoral Commissioners (RECs) squarely on the executive, including the provision of funding and ensuring a conducive environment for logistical deployment.

Highlighting the executive’s control over crucial aspects of the electoral process, Gabam questioned the true independence of INEC, stressing that the appointment of key officials and security arrangements ultimately lies within the purview of the executive. He emphasized the need to rethink the current structure and advocated for reforms to genuinely empower INEC as an independent institution.

To achieve true independence, Gabam proposed withdrawing the power to appoint the INEC Chairman and commissioners from the president. He also underscored the importance of impartiality among security personnel and collaborative support from all stakeholders. Gabam warned against further weakening the electoral system, attributing the challenges to various actors, including politicians, security agencies, and the media.

In conclusion, Gabam urged a collective commitment to strengthening national institutions and emphasized the necessity for the executive to refrain from interfering in INEC’s affairs. He argued that removing executive control over key appointments is vital for ensuring free, fair, and credible elections in Nigeria.
