In the sole remaining petition challenging Uba’s victory, the petitioners presented 24 witnesses who provided claims and documents as evidence.
Today, Monday, September 4, the parties involved in the petition will be presenting their final written arguments. Governor Sani, displaying confidence, chose not to call his listed witnesses, who were originally scheduled to defend his mandate in the final stage of the proceedings.
The governor stated that the petitioners had inadvertently helped confirm his fair and legitimate victory, specifically highlighting the admission of a star witness for the petitioner, Bonett Gwazah, a senior system analyst (SSA) in the VR/ICT Department of INEC in Kaduna State.
Through his counsel, the governor stated, “The petitioners called a total of 24 witnesses, most of whose statements on oath were filed pursuant to subpoenas issued during the petition’s hearing.”
He continued, “After the conclusion of the petitioners’ case, the 2nd Respondent (the governor) saw no need to call witnesses since sufficient evidence had been extracted during cross-examination to undermine the petitioners, who failed to meet the burden of proof placed on them by the law. The evidence elicited supports the defense asserted by the 2nd Respondent.”
Governor Sani’s legal team invited the Tribunal to take into account the crumbling of the petitioners’ witnesses during cross-examination and highlighted the significance of Gwazah’s capitulation, which, in their view, weakens the case of the PDP and Isa, who had called him as their star witness.
Chief Ojo, on behalf of his client, emphasized that Gwazah had submitted numerous INEC forms, voter registers, BVAS reports, and PVCs collected in nine Local Government Areas during the proceedings.
