The extended detention of former Central Bank of Nigeria Governor, Godwin Emefiele, without a trial has been deemed a blatant violation of his fundamental rights by the Federal Capital Territory High Court in Abuja. This judgment stems from a fundamental human rights lawsuit initiated by the former CBN governor in response to his prolonged detention in the custody of the Department of State Services. In his plea, Emefiele sought a court order directing the respondents to pay him N1bn in damages and to prohibit them from further arresting or detaining him.

Notably, Emefiele’s arrest occurred on June 10, shortly after his suspension by President Bola Tinubu. The defendants in the lawsuit include the Federal Government, the Attorney General of the Federation, the EFCC, and its chairman. The court’s decision serves as a significant legal development in addressing concerns related to the protection of fundamental rights and the legality of detentions in the country.
