The dismissed petitions were brought by the APC’s gubernatorial candidate, Akanimo Udofia, the YPP’s flagbearer, Akpan Albert Bassey, and the NNPP’s candidate, John James Akpan Udoedehe, concerning the March 18, 2023, election in Akwa Ibom.
During the proceedings, counsel for the respective parties attempted unsuccessfully to argue that ‘Emo Eno Bassey’ and ‘Bassey Eno Emo’ were distinct individuals, asserting that the governor had forged his Secondary School Certificate. The Supreme Court Justices, particularly disapproving of the forgery allegations, questioned the lawyers on whether the West African Examinations Council (WAEC) presented evidence to support the criminal accusations.
Upon the admission that WAEC did not testify in the matter, the lawyers chose to withdraw their appeals separately. Justice Uwani Abba-Aji subsequently dismissed the petitions with no objections from the respondents’ lawyers.
Notably, the Supreme Court did not impose costs on the appellants’ lawyers, as they voluntarily withdrew their cases based on the lack of merit. The Court of Appeal in Lagos had earlier affirmed Governor Umo Eno’s election in November of the preceding year, dismissing three separate appeals against the election filed by the YPP, NNPP, and APC. The appellate court, led by Justice Festus Obande, upheld the judgments of the election petition tribunal, declaring that all three appeals lacked merit.
