Justice Ambrose Lewis-Alagoa also cleared the club’s supervisor, Joachim Hillary, ruling that the prosecution failed to establish a prima facie case against both defendants.
The pair had been charged by the National Drug Law Enforcement Agency on three counts, including conspiracy, unlawful possession of drugs, and allowing the use of the nightclub premises for illegal drug activities.
The charges stemmed from an NDLEA raid on Pretty Mike’s nightclub in Victoria Island on October 26, during which officials claimed to have seized 169 cylinders of nitrous oxide (commonly known as laughing gas) weighing 384.662 kilograms, as well as 200 grams of cannabis sativa.
Prosecutors alleged that the substances were intended for use at an illegal drug party and sought to link the defendants to their possession and storage, while also pushing for the forfeiture of the nightclub.
At the close of the prosecution’s case, defence counsel, Chikaosolu Ojukwu (SAN), filed a no-case submission, arguing that the evidence presented was insufficient and failed to directly connect the defendants to the alleged offences. He stressed that mere suspicion could not sustain a criminal charge and that the prosecution did not prove ownership, control, or knowledge of the substances.
In his ruling, Justice Lewis-Alagoa agreed with the defence, stating that the evidence presented lacked the strength and clarity required to establish a prima facie case. He held that the allegations amounted only to suspicion and were not enough to compel the defendants to enter a defence.
The court consequently upheld the no-case submission and discharged both Pretty Mike and Hillary, effectively ending the case at the preliminary stage.
