The new case, labeled FHC/ABJ/CR/195/25, was submitted to the Federal High Court in Abuja on May 22, 2025 — just weeks after a similar charge, CR/297/25, was initiated at the FCT High Court. Both charges stem from comments allegedly made by the senator, which the government claims were defamatory toward Senate President Godswill Akpabio and former Kogi State Governor Yahaya Bello.

While the FCT High Court case is based on Section 392 of the Penal Code, addressing criminal defamation, the Federal High Court case is grounded in Sections 24(1)(b) and 24(2)(c) of the Cybercrime (Prohibition) Act, 2024 (as amended). The federal government alleges that Akpoti-Uduaghan posted online statements capable of harming the public reputation of both Akpabio and Bello.

Senator Akpoti-Uduaghan has firmly denied the accusations, describing them as politically driven attempts to silence opposition voices.

The filing of near-identical charges in separate courts has sparked allegations of forum shopping — a controversial legal maneuver where parties pursue similar suits in multiple jurisdictions to secure favorable outcomes.

The senator is scheduled to appear before the Federal High Court for arraignment on June 30, 2025, following her earlier bail granted by the FCT High Court on June 19, 2025.
