These pleas were presented in a fundamental rights enforcement suit filed by Anana on behalf of Abdulrasheed Bawa. The lawsuit targets the Director-General of the DSS, the Attorney-General of the Federation, and the Minister of Justice.
Bawa has remained in custody since June 14, 2023, following his arrest by DSS operatives.
Anana’s suit, identified as FHC/L/CS/1631/2023, is pending assignment to a judge. The lawsuit seeks an order compelling the immediate release of Abdulrasheed Bawa from detention by the first and second respondents.
Furthermore, the lawyer is seeking either a bail order for Bawa on lenient terms or an order requiring the respondents to bring him before the court to present reasons why he should not be granted bail.
Anana emphasizes that the suit is based on the Fundamental Rights Enforcement (Civil Procedure) Rules 2009, Section 46(3) of the Nigerian Constitution, the African Charter on Human and Peoples’ Rights, and the court’s inherent jurisdiction.
The applicant also prays for several other reliefs, including a declaration that the continuous detention of Abdulrasheed Bawa by the DSS violates his fundamental rights, as outlined in the Nigerian Constitution and the African Charter of Human and Peoples’ Rights.
Anana asserts that Bawa’s ongoing confinement contradicts the Nigerian Constitution and the African Charter of Human and People Rights. He emphasizes that Nigeria is not a police state where law enforcement’s discretion supersedes the rule of law.
