In a statement, Falana emphasized that the government, led by President Bola Tinubu, has a constitutional obligation to fund the education of these children. The defendants have also filed a notice of preliminary objection, requesting the judge to decline jurisdiction over the case and to order that the complainant cover their school fees until at least senior secondary school or university level.

Falana argued that this request aligns with various legal provisions, including Section 18 (3) (a) (b) (c) of the 1999 Constitution, Section 15 of the Child’s Rights Act, Section 2 of the Universal Basic Education Act, and Article 17 of the African Charter. He asserted that the Federal High Court lacks jurisdiction under Section 251 of the Constitution, as these minors should be handled within the child justice system according to Section 204 of the Child’s Rights Act.

The application underscores the defendants’ rights under juvenile justice laws and emphasizes the government’s duty to fulfill its educational commitments to Nigerian youth.

Additionally, it was reported that the Federal High Court, presided over by Justice Obiora Egwuatu, recently granted bail to 76 protesters involved in the #EndBadGovernance demonstration. While adult defendants were granted bail at N10 million each, the court required the parents of the minors to take responsibility for their bail. However, attorney Deji Adeyanju expressed concern that the stringent bail conditions imposed on the protesters, who have been in custody since August, have led to some being returned to prison.
