This was revealed during a session at the Federal High Court, where the IGP’s legal representative, A.M. Abdullahi, informed Justice Mohammed Umar that the AGF’s office had reviewed the matter and given the green light for prosecution.

The case, originally filed on October 10, 2024, involved a two-count charge against Uba, Crystal Uba, and Benjamin Etu. However, in an amended charge dated March 4, 2025, Crystal Uba’s name was dropped, leaving Uba and Etu as the remaining defendants.

According to the charges, Uba, Etu, and one Hajiya Fatima (still at large) allegedly conspired in 2022 to fraudulently obtain ₦400 million from one George Uboh under the false pretext of securing the position of Managing Director at the Niger Delta Development Commission (NDDC) for him.

The charge states: “A representation which you knew to be false, thereby committing an offence contrary to Section 8 and punishable under Section 1(3) of the Advance Fee Fraud and Other Fraud Related Offences Act, 2006.”

Uboh had earlier petitioned the IGP on April 5, 2023, submitting both documents and voice recordings as evidence. The prosecution plans to call six witnesses in the case.

Previously, the AGF had agreed to review the case file following a petition by the defendants. However, a letter dated May 8 from M.B. Abubakar, Director of Public Prosecutions (DPP), confirmed a prima facie case against Uba, Etu, and Fatima, while clearing Crystal Uba of any involvement.

When the matter resumed in court on Monday, only Etu and his counsel, C.F. Odiniru, were present. Odiniru informed the court that Uba was currently abroad receiving medical treatment and also claimed that the disputed sum had already been refunded.
