The Delta State High Court in Effurun has dismissed the preliminary objections filed by Nigerian-American singer David Adedeji Adeleke, popularly known as Davido, and his company, Davido Music Worldwide Limited. In the case of Brownhill Investment Company Limited vs. Davido & Davido Music Worldwide Limited (Suit No. EHC/183/2023), the court rejected the defendants’ arguments that the matter should be treated as a debt recovery case and deemed premature, as no letter of demand for a refund had been issued by the claimant. The court agreed with the claimant’s counsel, emphasizing that the reliefs sought in the writ of summons collectively indicated a breach of contract action. The court asserted that such cases do not require a prior letter of demand.

Regarding the defamation case, the court affirmed its territorial jurisdiction in the High Court of Delta State. It established that the claimant, a resident of Delta State, was present in the state when the alleged defamatory publications were posted online by the defendants. Despite discussions of a possible out-of-court settlement during proceedings, no concrete arrangements were made. The claimant, Brownhill Investment Company Limited, represented by lawyer Kelechi Onwuegbuchulem, had sought N2 billion in general damages against Davido in the lawsuit. Efforts for an out-of-court settlement were hindered as the defendants insisted on terms that the claimant found unacceptable.
