The delay arose following the objection raised by the prosecution counsel, Osuobeni Akponimisingha, who claimed to have just received Ndifon’s additional affidavit. He requested time to examine the document to ensure a fair hearing.

Solomon Umoh, SAN, representing Ndifon, and Sunny Anyanwu, the co-defendant, expressed discontent with the development.

The Independent Corrupt Practices and Other Related Offences Commission (ICPC) is prosecuting Ndifon and Anyanwu on charges related to sexual harassment and intimidation of the key witness in the case.

Anyanwu, also a defense lawyer, was added to the amended charge on January 22. He is accused of threatening a prosecution witness during the ongoing case against Ndifon.

On Thursday, Justice Omotosho had ordered the remand of both defendants in Kuje Correctional Centre until the bail hearing. He decided to address the bail request after the trial.

When the trial resumed on Friday, Umoh urged the court to prioritize the bail applications before continuing with the trial. However, Akponimisingha opposed, citing the court’s previous directive to proceed with the trial first.

The ICPC lawyer claimed he had just received Umoh’s latest application on Thursday and needed time to review it before responding. Umoh countered, stating that Akponimisingha was aware of the attached medical report and argued that the new application was merely a supplement.

Umoh mentioned that when the judge granted Ndifon temporary bail on January 10 for a scheduled glaucoma surgery on January 11, it took about a week to finalize the bail arrangements. He emphasized that the documents attached to the current bail application had already been verified by the ICPC in Exhibit PF3.
