U.S. Judge Orders Release Of President Bola Tinubu’s Academic Records, Limited Impact Expected

The decision, delivered on Tuesday, instructs CSU to provide all “relevant and non-privileged documents” to Abubakar Atiku, the plaintiff, within a two-day timeframe.
While this ruling is seen as a victory for Atiku, it’s unlikely to yield additional information beyond what CSU has already made public.
Tinubu’s legal team has maintained their client’s right to protect his privacy, and the ruling acknowledges this by specifying “non-privileged documents.”
In previous depositions, the university consistently affirmed Tinubu’s attendance and graduation in 1979. As such, Atiku is expected to receive copies of Tinubu’s academic records, which may include admission letters and exam sheets. However, there is no anticipation of groundbreaking revelations from this development.
The information requested by Atiku is intended for use in his legal challenge against Bola Tinubu’s election. Atiku recently approached the Supreme Court to overturn the judgment of the Presidential Election Petition Court (PEPC), which upheld Tinubu’s election on September 6.
In his Notice of Appeal, Atiku, represented by Chief Chris Uche, SAN, presented 35 grounds on which he argued that the tribunal had committed serious errors and a miscarriage of justice in its findings and conclusions related to his petition.
H contended that the tribunal failed to nullify the election due to non-compliance with the Electoral Act 2022, citing evidence of grave misrepresentation by INEC.
Atiku also emphasized the “doctrine of legitimate expectation” as a key point in his appeal, claiming that the tribunal had erred in not considering it when INEC deviated from its own guidelines and the Electoral Act 2022 during the election.
