In the letter dated October 1, Beke stated that Okocha’s Caretaker Committee is unofficial and lacks the legal authority to represent the party in Rivers State. The letter outlined that the elected State Executive Committee had approached the High Court of Rivers State, where Justice S.H. Aprioku affirmed the validity of their committee until 2025 and dismissed the legitimacy of Okocha’s caretaker committee.

Beke’s letter read: “The court set aside the purported caretaker committee of Chief Tony Okocha and declared that our duly elected State Executive Committee, led by Chief Emeka Beke, is the authentic leadership of the APC in Rivers State.

“We acknowledge that the Federal High Court, presided over by Justice Peter Lifu, delivered a judgement in Suit No. PHC/ABJ/CS/987/2024. However, we wish to clarify that Chief Tony Okocha, who filed that suit claiming to be ‘Chairman, Caretaker Committee’ of the APC in Rivers State, is an impostor and does not hold any official position within the party.”

Beke emphasized that Okocha lacks the authority from the party’s legitimate leadership to file or maintain the suit. He asserted that the judgement affirming their committee’s authority takes precedence due to its timing.

He continued: “Under the APC constitution, decisions regarding participation in local government elections fall under the authority of the State Executive Committee. Thus, it is our committee, led by Chief Emeka Beke, that determines how the Rivers State Chapter of the APC will engage in the upcoming elections.”

Moreover, Beke referenced a Supreme Court ruling that mandated the Rivers State Government to conduct local government elections within three months of its judgement, stating that the Federal High Court cannot overrule the Supreme Court’s authority in this matter.

Consequently, the Beke-led faction officially informed INEC of their support for the local government elections on October 5th, asserting that the party is participating and has submitted the names of its candidates for various positions.

Beke reiterated that the judgement in Suit No. FHC/ABJ/CS/987/2024 does not reflect the interests of the Rivers State Chapter of the APC and distanced their faction from it.
